In limango Case, Munich Court Rules Coupling Newsletter to Account Registration Unlawful

News contents

Vzbv reported that the Munich Higher Regional Court ruled against limango over mandatory newsletter consent during registration; the April 23 judgment is not final.

On October 5, the Federation of German Consumer Organisations (vzbv) announced that the Munich Higher Regional Court (OLG München) upheld the association’s lawsuit against limango GmbH regarding the coupling of online shop registration with consent to promotional newsletters. According to vzbv, the judgment of April 23, 2026 (case ref. 29 U 599/24 e) has not yet attained final legal force.

    Key points
    • According to vzbv, when registering on limango, users had to confirm both account creation and consent to receiving marketing emails with a single click.
    • The Munich Higher Regional Court upheld vzbv’s claim; the April 23, 2026 ruling is not yet legally binding.

    How the registration process functioned

According to vzbv, after signing up on the limango website, users were sent a confirmation email requiring them to confirm both their registration and newsletter consent with a single button click. Without granting such consent, the consumer association noted, access to the online retailer’s Shopping Club was denied.

The email cited by vzbv read: “Confirm your registration at limango and your consent to receive our newsletter by clicking ‘CONFIRM’.” The vzbv stated that consumers had no opportunity to decline the newsletter while still completing their account registration.

Court findings as reported by vzbv

As vzbv outlines, the Munich Higher Regional Court found that bundling the registration with newsletter subscription infringed the requirement that consent must be freely given. According to the association’s publication, the court rejected the notion that it was sufficient for users to initially subscribe and subsequently revoke consent in a separate step.

Vzbv further reported that the court dismissed the retailer’s argument that newsletter distribution was indispensable to its business model.

Ruling is not yet legally binding

Vzbv indicates that the OLG München judgment was handed down on April 23, 2026 (file number 29 U 599/24 e) and has not yet entered into legal force as of the publication date. The organization also reported that the appeals court overturned the earlier ruling by the Munich I Regional Court (Landgericht München I) on this matter.
